MRIYA.FISH Terms of Use
The app helps you control your boat, but it does not replace your attention: keep the boat in sight whenever it is on the water. By installing or using the app you accept these terms.
1. General
These terms apply between you and FOP Oleksandr Nedobeha ("we") for the MRIYA.FISH app. The app is free and is meant for controlling MRIYA.FISH boats. How we handle personal data is described in the Privacy Policy: https://mriya.fish/privacy. If you do not agree with these terms, do not use the app.
2. Licence
We grant you a free, non-exclusive right to use the app on your devices. The right covers controlling MRIYA.FISH boats that you lawfully own or use, and lasts as long as you follow these terms.
You may not:
- decompile or modify the app or bypass its protection, except where the law expressly allows it;
- extract firmware, access keys or other data from the app or the server, or distribute them;
- use the app or the update server for devices other than MRIYA.FISH boats;
- interfere with the update server or load it with automated requests.
If you turned on sending of depth recordings, you grant us a free, perpetual, non-exclusive licence to use anonymised depth recordings and the lake maps built from them, including to improve the app and to create shared lake maps. The licence does not cover personal data: we process it under the Privacy Policy.
The app includes open-source libraries; their licences are listed on the app's About screen. The rights to the app, the firmware and the MRIYA.FISH trademark belong to us.
3. Safe use
You are responsible for operating the boat. In particular:
- keep the boat in sight while it is on the water and be ready to take control;
- follow fishing rules, the rules of the water body and local restrictions;
- do not run the boat near swimmers or other vessels, or in prohibited and protected areas;
- check the boat and phone batteries before going out;
- do not go out in storms, strong wind or poor visibility.
The autopilot relies on GPS and Bluetooth. GPS error is several metres, and trees, banks and weather can weaken the signal. The link is limited by distance and obstacles. The app cannot see obstacles in the boat's path.
4. Firmware updates
- Start an update when the boat is on shore, the mission has ended and the phone is charged.
- Do not close the app or walk away from the boat until the update finishes.
- If an update fails, try again or write to us: mriyafish@gmail.com.
We may release app and firmware updates that change or remove features. We are not obliged to support old versions.
5. Third-party services
Maps come from OpenStreetMap, Esri, OpenTopoMap and MapTiler. Their terms apply independently of ours, and their availability is outside our control. Maps show the area approximately and are not intended for marine navigation.
6. Liability
The app is provided "as is". We work to keep it reliable, but we do not guarantee uninterrupted or error-free operation, including of the maps and the update server.
To the extent the law allows, we are not liable for indirect losses, lost profit, loss of data or catch, or for damage resulting from a breach of section 3.
These terms do not limit your consumer rights under the law of Ukraine or, for EU residents, under the mandatory rules of your country of residence. Nor do they limit our liability for damage caused intentionally or through gross negligence. The boat warranty is governed by the warranty card, separately from these terms.
The boat's board keeps a service log: distance covered, running hours, errors, operation outside permitted limits (current, temperature, battery discharge, impacts) and firmware history. When you make a warranty claim, we read this log, either from a report you send from the app or when you hand the boat over for service. Without it, we may be unable to assess the claim. Attempts to erase or alter the log or the board firmware void the warranty to the extent the law allows.
7. Changes and termination
We may change these terms. We publish each new version at https://mriya.fish/terms and announce significant changes in the app. If you keep using the app after a change takes effect, you accept it.
You can stop using the app at any time by uninstalling it. We may restrict access to the update server if you breach these terms.
8. Governing law and disputes
These terms are governed by the law of Ukraine. We first try to settle any dispute by negotiation. If that fails, a Ukrainian court with jurisdiction decides it. Consumers in the EU keep the right to go to the courts of their country of residence.
